1. Booking and Payment
- All bookings must be fully paid prior to the date of the tour or cruise unless otherwise agreed in writing.
- Bookings are confirmed only once full payment is received. Tentative or provisional bookings are not guaranteed.
- We accept payments via major credit cards, bank transfer, or other methods as advised at the time of booking.
- For bookings made within 14 days of the tour date, full payment is required immediately to secure the reservation.
2. Changes and Cancellations
- Cancellations made more than 30 days before the scheduled tour date are eligible for a full refund.
- Cancellations made between 14 and 30 days before the tour may incur a cancellation fee (e.g., 50% of the booking value).
- Cancellations within 14 days of the tour date are non-refundable unless agreed otherwise.
- We reserve the right to cancel or reschedule tours due to weather conditions, safety concerns, or unforeseen circumstances. In such cases, a full refund or rescheduling option will be offered.
- We are not liable for any additional costs incurred by customers due to cancellations or delays (e.g., travel, accommodation).
3. Safety and Conduct
- All passengers must comply with the safety instructions and directions given by the crew and captain at all times.
- The vessel is equipped with necessary safety equipment, including life jackets, which must be worn as instructed.
- Passengers must not be under the influence of alcohol or drugs when boarding or during the tour. The crew reserves the right to refuse service or disembark any passenger behaving in an unsafe or disruptive manner without refund.
- Smoking is not permitted on board.
- Passengers are responsible for their personal belongings; Sydney Harbour Boat Tours and Cruises is not liable for loss or damage.
4. Liability and Waiver
- Participating in boat tours and cruises involves inherent risks, including but not limited to rough waters, weather changes, and physical activities. By booking, passengers accept these risks voluntarily.
- Sydney Harbour Boat Tours and Cruises and its crew disclaim liability for any injury, loss, or damage sustained by passengers, except where caused by proven negligence of the company.
- It is the responsibility of passengers to inform the company of any medical conditions or special needs prior to the tour.
5. Photography and Privacy
- Photographs or videos may be taken onboard for promotional purposes. By participating, passengers consent to the use of such images unless otherwise requested in writing.
6. Environmental Responsibility
- We are committed to preserving the harbour’s natural environment. Passengers are asked to respect marine life and dispose of waste responsibly.
7. Force Majeure
- Sydney Harbour Boat Tours and Cruises shall not be liable for failure to perform, or delay in performance of, any of its obligations resulting from events beyond its reasonable control, including natural disasters, government actions, or other emergencies.
8. Governing Law
- These Terms and Conditions are governed by the laws of New South Wales, Australia. Any disputes arising shall be subject to the jurisdiction of the courts in New South Wales.
9. Acceptance of Terms
- By making a booking with Sydney Harbour Boat Tours and Cruises, you agree to be bound by these Terms and Conditions and confirm that you have conveyed these terms to all members of your party.
